Mr. Leimkuhler’s litigation and arbitration practice focuses on complex insurance and reinsurance coverage matters.  For over fifteen years he has advised London Market and North American insurers and reinsurers on a wide variety of insurance and reinsurance issues, including environmental, asbestos, health hazard, political risk, workers’ compensation, personal accident, medical, professional liability and other claims; the allocation of losses; reinsurance accounting issues; claims of misrepresentation and nondisclosure in the placement of coverage; and inter-jurisdictional legal questions arising out of international reinsurance transactions.   Mr. Leimkuhler’s practice encompasses counseling as well as litigation and appellate work in federal and state courts, arbitration of reinsurance disputes, judicial review of arbitration proceedings, and mediation and negotiation.  He has extensive trial and arbitral hearing experience.  In one such proceeding, a three-month trial, Mr. Leimkuhler’s representation of certain London Market insurers resulted in a judgment of rescission for the insurers against a Fortune 100 policyholder, avoiding $70 million of potential liabilities.

Apart from his broad insurance and reinsurance expertise, Mr. Leimkuhler has successfully litigated cases involving claims of fraud, breach of contract, professional negligence, interference with property rights, and discrimination in employment and public accommodations.  He was co-lead counsel in a national class action on behalf of plaintiffs who alleged that they were denied equal access to health club memberships on account of race, which resulted in one of the largest settlements in a U.S. public accommodations discrimination matter.
